Privacy Policy

This Privacy Policy explains what information FaNILy collects, how we use it, and the choices you have. It covers fans and visitors to the FaNILy website and app.
1. Overview
This Privacy Policy explains how Fanily Ventures LLC ("FaNILy", "we", "us") collects, uses, and shares information when you use the FaNILy mobile application and the website at gofanily.com (together, the "Platform"). By using the Platform you agree to this Policy.
2. Age requirement
The Platform is for users 18 and older, and we do not knowingly collect personal information from anyone under 18. If we learn that an account belongs to someone under 18, we will close the account and delete or de-identify the associated personal information, subject to the retention rules in Section 6 and to applicable law. A parent or guardian who believes someone under 18 has provided us personal information can contact us at support@gofanily.com.
This applies to everyone, including athletes. There is no younger-athlete path.
3. Information we collect
Information you provide:
- Account information: name, email address, date of birth (to verify the age requirement), username, and password.
- Purchase information: items you buy, order history, and requests you submit for personalized content.
- Payment information: processed by our payment processor, Stripe. We receive transaction confirmations and limited payment details (such as card brand and last four digits) but never your full card number.
- Communications: messages you send to support and content you submit through the Platform.
- Likeness materials, if you are an athlete: a photograph of your face ("selfie") and an image of your handwritten signature, which you upload during onboarding. We use these only as reference material to create your own branded images - banners and trading cards - and to place your signature on them. Section 4 explains how they are used and Section 5 explains who processes them.
- Your connections to schools, teams, and organizations, if you choose to add them: which organization, what the connection is - for example alumnus, current or former student, faculty or staff, a coach, a team volunteer, a season-ticket holder, or a family connection such as being the parent, guardian, sibling, or spouse of a student or athlete - and details you supply about it, such as a role or title at that organization, a degree or program, a graduating class, and the years the connection ran. All of it is optional and you can change or remove any of it. Some connections describe your relationship to another person, for example that you are the parent of a particular athlete: we record the relationship and who it refers to, we do not ask you for that person's contact details, and adding the connection does not give us permission to contact them.
- Verification and correction materials: if you ask us to confirm one of these records, or ask us to correct or remove a record about you, we collect what you send in support of it - your description of the problem, the correction you are asking for, your relationship to the record, and any document or image you attach as evidence - together with the name and email address you give us so we can contact you about the request.
Information collected automatically:
- Device and usage information: device type, operating system, app version, IP address, and how you use the Platform, such as pages viewed and features used.
- Cookies and similar technologies on the website, used for sign-in, preferences, and analytics that tell us how the Platform is used.
- Content activity: which posts, videos, and cards you open, how far through a video you get, and when you replay, react to, save, share, or report something, along with the part of the Platform you did it from and basic device information such as device type, operating system, and browser. We use it to make what you see more relevant, to tell an athlete how their content performed, and to understand how the Platform is used. We keep it for a shorter period than the rest of your information - see Section 6.
Information from athletes: athletes provide additional onboarding information governed by their agreements with us. This Policy covers that data where it is processed on the Platform.
4. How we use information
- To operate the Platform: create accounts, process purchases, deliver content, and pay athletes their share.
- To verify eligibility, including the minimum age requirement.
- To create an athlete's branded images: an athlete's selfie and signature are used as reference material by automated image-generation services to produce their banner and trading cards. We also run automated checks on these uploads to confirm a face is visible and the image is usable. We do not use them to identify anyone, and we do not sell them.
- To remember the teams, athletes, and organizations you follow or tell us you are connected to, and to show them back to you on the Platform.
- To check a connection you have added when we or you have asked for it to be verified, and to review and act on a request to correct a record.
- To provide support and respond to requests, including refund requests.
- To keep the Platform safe: fraud prevention, content moderation, and enforcement of our Terms of Service.
- To improve the Platform through analytics and product development.
- To send service communications, and, with your consent where required, marketing communications you can opt out of at any time.
- To comply with law, including tax and financial reporting obligations.
5. How we share information
We do not sell your personal information for money. Some sharing that an applicable law might treat as a "sale" or "share" is on by default, and you can turn it off at any time as described in Section 7 and in the Do Not Sell or Share notice at the end of this Policy. We share information only with:
- Service providers who process data for us, including Stripe (payments), Heap (product analytics), Google Analytics (website analytics), cloud hosting, email and messaging providers, customer support tools, and artificial-intelligence image providers who generate athlete banners and trading cards from an athlete's selfie. All are bound by contract to use data only for the services they provide us.
- Athletes, to the limited extent needed to fulfill your purchase, for example the request details you submit for a personalized video. Athletes do not receive your payment information.
- Participating schools and athletic organizations you have bought from. This is on by default. A school can see your name, your email address, and a summary of your activity with that school - how much you have sent it in total, how many purchases you have made, and when the first and most recent were - so it can contact you about its alumni, events, ticketing, and membership programs. We do not share your payment information or an itemized list of what you bought. You can turn this off at any time in your account settings, which stops future sharing - but a school that has already seen your details keeps its own records, and we cannot retract those.
- Separately from that setting, a school can see counts - for example how many people on FaNILy have marked themselves as its alumni. Counts do not identify anyone and do not include your name, email address, or purchases.
- Legal and safety recipients, when required by law, legal process, or to protect the rights and safety of users, athletes, or the public.
- A successor entity in connection with a merger, acquisition, or sale of assets, in which case this Policy continues to apply to your data.
6. Data retention
We keep personal information for as long as your account is active and as needed for the purposes above, including legal, tax, and dispute obligations. Transaction records are retained as required by financial regulations. When data is no longer needed, we delete or de-identify it.
Content activity - the viewing and interaction records described in Section 3 - is kept on a shorter clock: about 90 days, and in no case more than roughly 120. It expires in monthly blocks rather than one record at a time, so the oldest records we still hold can be up to a month older than the 90-day figure. We publish the range rather than a single number because the range is what the system actually does.
7. Your choices and rights
- Access and a copy of your data: you can access and update account information in the app, and download a complete copy of your data yourself from your account page. We ask for your password first, and the download link expires after 24 hours.
- Deletion: you can close your account from your account page. To have your information deleted or de-identified beyond that, email support@gofanily.com. Some records are retained as described in Section 6.
- Correcting a record about you: if something we show about you is wrong, out of date, or is not you at all, you can ask us to fix it at gofanily.com/report/record. You do not need a FaNILy account to ask. Section 3 describes what we collect when you make the request.
- School and organization sharing: this is on by default. Your name, email address and a summary of your activity are shared with schools and organizations you have bought from, as described in Section 5. You can turn it off at any time in your account settings, and turning it off stops future sharing.
- Marketing: opt out of marketing emails via the unsubscribe link in any marketing email, or in your account settings. Service messages about your purchases and account are sent regardless.
- Cookies: manage cookies through your browser settings.
State privacy rights: depending on where you live, you may have rights under your state's privacy law, including the right to access, correct, delete, and receive a copy of your personal information, and to opt out of any sharing that qualifies as a "sale" or "share" of personal information. The school and organization sharing described in Section 5 is on by default and can be turned off at any time in your account settings, which is how you exercise that opt-out. To exercise any other right, or to ask a question about how we handle your information, email support@gofanily.com. We will not discriminate against you for exercising a privacy right.
8. Security
We use reasonable technical and organizational safeguards to protect personal information, including encryption in transit, access controls, and payment processing through a PCI-compliant processor. No system is completely secure, so we cannot guarantee absolute security.
9. International users
FaNILy is operated from the United States and our own systems and databases are hosted there. Some of our service providers operate globally and may process limited information outside the United States on our behalf. Wherever they process it, they are bound by contract to use it only to provide services to us.
If you access the Platform from outside the United States, you understand that your information will be processed in the United States.
10. Changes to this Policy
We may update this Policy. If we make material changes, we will notify you through the app or by email and post the updated Policy with a new effective date.
11. Do Not Sell or Share My Personal Information
We do not sell your personal information for money, and we never have. California and several other states define "sale" and "share" broadly enough that the school and organization sharing described in Section 5 may qualify, so we treat it as though it does.
That sharing is on by default. To opt out, open your account settings and switch off "Let schools and organizations I buy from see my details". It takes effect immediately and applies to every school and organization. You do not need to contact us, and we will not ask you why.
Turning it off stops future sharing. A school that has already seen your details keeps its own records, and we have no way to retract those - so the opt-out is forward-looking, and we would rather say that plainly than imply otherwise.
If you cannot reach your account settings, email support@gofanily.com from the address on your account and we will action it for you. We will not discriminate against you for opting out.
